    Seller Privacy Policy

    Motoguys (“We”, “Us”, “Our”) is committed to protecting the personal data of Sellers and their authorised representatives (“You”, “Your”). This Seller Privacy Policy describes how we collect, use, share, and protect Your information in connection with the Motoguys seller programme. This Policy is issued in compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act), the Information Technology Act, 2000 (IT Act), and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (SPDI Rules).

    1. Personal Data We Collect

    We collect the following categories of personal data from You:

    1.1 Identification & Contact Data

    • Full name of the applicant / authorised representative
    • Business / brand name
    • Mobile number and email address
    • Business address

    1.2 Business & Financial Data

    • Business type, product categories, and monthly capacity
    • GSTIN, PAN, and bank account details (at onboarding)
    • Transaction history, commission records, and payout data

    1.3 Technical Data

    • IP address and device/browser information collected at form submission
    • Login timestamps and session data
    • Cookies and analytics data (see Section 8)

    1.4 Communication Data

    • Messages exchanged through the Platform’s support channels
    • Application notes and onboarding correspondence

    2. Purpose of Processing Your Data

    We process Your personal data for the following purposes:

    3. How We Share Your Data

    We do not sell Your personal data. We may share it with:

    • Service Providers: Payment gateways, logistics partners, cloud hosting providers, and email/SMS service providers engaged to operate the Platform — under contractual confidentiality obligations.
    • Tax & Regulatory Authorities: The Goods and Services Tax Network (GSTN), Income Tax Department, and other statutory bodies as required by law.
    • Law Enforcement: Government agencies or courts when required under the IT Act, 2000 or any lawful order.
    • Affiliated Seller Groups / Partner Networks: Only if You have explicitly opted-in via the seller application form. You may withdraw this consent at any time by contacting us.

    4. Cross-Border Data Transfers

    Your personal data is primarily stored and processed on servers located within India. If any processing occurs outside India (e.g., via a cloud service provider), we ensure adequate contractual safeguards are in place in accordance with Section 16 of the DPDP Act, 2023 and Central Government notifications thereunder.

    5. Data Retention

    We retain Your personal data for the following periods:

    • Seller application data: 3 years from the date of application (regardless of status).
    • Active seller account data: Duration of the seller relationship plus 7 years thereafter (for tax compliance).
    • Transaction & financial records: 8 years as required under the Income-tax Act, 1961.
    • Communication logs: 2 years from the date of communication.

    After the applicable retention period, data is securely deleted or anonymised in accordance with the DPDP Act, 2023.

    6. Your Rights Under the DPDP Act, 2023

    As a Data Principal under the Digital Personal Data Protection Act, 2023, You have the following rights:

    • Right to Access (Section 11): Request a summary of Your personal data processed by us and the processing activities.
    • Right to Correction & Erasure (Section 12): Request correction of inaccurate or incomplete data, or erasure of data that is no longer necessary or for which consent has been withdrawn.
    • Right to Grievance Redressal (Section 13): Lodge a grievance with Our Grievance Officer (details below). If not resolved, You may escalate to the Data Protection Board of India under Section 28 of the DPDP Act.
    • Right to Nominate (Section 14): Nominate another individual to exercise Your rights in the event of Your death or incapacity.
    • Right to Withdraw Consent: Withdraw consent for marketing communications or data sharing with partner networks at any time. Withdrawal shall not affect the lawfulness of processing based on consent before its withdrawal.

    To exercise any of these rights, please email our Grievance Officer (see Section 9). We will respond within 30 days.

    7. Data Security

    We implement reasonable security practices and procedures as mandated under Rule 8 of the SPDI Rules, 2011, including but not limited to: TLS/HTTPS encryption in transit, AES-256 encryption at rest for sensitive data, role-based access controls, and periodic security audits. In the event of a personal data breach, We will notify affected parties and the Data Protection Board of India as required under the DPDP Act, 2023.

    8. Cookies & Tracking Technologies

    The Platform uses cookies and similar tracking technologies to maintain session state, analyse usage patterns, and improve the seller experience. You may configure Your browser to refuse cookies; however, some Platform features may not function correctly as a result. Analytics data is collected in compliance with the IT Act, 2000 and applicable guidelines.

    9. Grievance Officer & Contact

    In accordance with the IT Act, 2000 (Section 79) and the DPDP Act, 2023, We have designated a Grievance Officer. If You have any concerns about the processing of Your personal data, please contact:

    10. Changes to This Policy

    We may update this Privacy Policy from time to time. The revised Policy will be posted on this page with an updated effective date. We encourage You to review this page periodically. Continued use of the seller programme after the effective date of the revised Policy constitutes Your acceptance.
